REQUEST FOR RELEASE OF

BOND (U-26)

White River Coal, Inc., has filed a request with the Indiana Department of Natural Resources, Division of Reclamation, for the release of Regrade Release (20.8 acres Phase I at 60%), Revegetation Release (21.6 acres Phase II at 25%) and Final Release (85.9 acres Phase III at 15%) of the performance bond posted to ensure reclamation of permit #U-26, commonly known as Hazleton Mine. This permit had been approved by the Natural Resources Commission on February 4, 2002. The requested release area is located in Parts of Military Donations 101 and 108, all in Township 1 South, Range 10 West, Gibson County, Indiana, and would be a release of $307,650.00 of the total $307,650.00 now being held by the Division of Reclamation for the above acreage.

This request is made pursuant to Indiana Code 14-34 and 312 Indiana Administrative Code 25-5-16, and is based upon the Fall 2007, Spring 2008 and Fall 2008 completion of grading and revegetation as specified in the approved plan of reclamation.

Any person with a valid legal interest, as defined in 312 Indiana Administrative Code 25-1-104, and the head of Federal, Indiana or local government entities with jurisdiction over environmental protection standards, may submit written comments, file objections to the release, request an informal conference to discuss the release or request a hearing to determine if the bond should be released. Written comments or requests must be submitted no later than thirty (30) days from the last date of publication of this notice to the Division of Reclamation, 14619 West State Road 48, Jasonville, Indiana 47438-9517.
