Permit #S-00335 Renewal #4

In accordance with Indiana Administrative Code 312 IAC 25-4-129, Peabody Midwest Mining, LLC, 566 Dickeyville Road Lynnville, IN 47619 herewith provides public notice of application for Renewal #4 of mining permit #S-00335 and amendments at the Somerville South Mine, located approximately 1 mile east of Buckskin, Indiana. The area is contained within the area covered by the Oakland City, Elberfeld and Lynnville U.S.G.S. 7.5 minute quadrangle maps.

The original permit area is described as follows: The SW ¼, the SW ¼ and the West ½ of the NW ¼ of the SE ¼, and the NE ¼ of Section 25; the SW ¼ and the SE ¼ of Section 26; the NE ¼, the SE ¼, the NW ¼, and part of the NW ¼ and part of the SE ¼ and the NE ¼ of the SW ¼ of Section 35; and the NW ¼, the NE ¼ and the SW ¼ of the NW ¼ and the NW ¼ and part of the SW ¼ of the SW ¼ of Section 36; all located in T3S; R9W. And part of the NW ¼ of the NW ¼ of Section 30; T3S; R8W.

Permit amendment area S-335-1 is described as follows: Portions of the SW ¼ and SE ¼ of Section 23; Portions of the SW ¼ of Section 24; Portions of NW ¼ Section 25; and the N ½ of Section 26 all located in T3S, R9W

Permit amendment area S-335-2 is described as follows: The SW 1/4 of Section 18; The NW 1/4 and portions of the SW ¼ of Section 19 located in T3S, R8W; Portions of NE 1/4 of the NE 1/4, Portions of the SE 1/4 of the NE 1/4, The NW1/4 of NE 1/4, The SW 1/4 of the NE 1/4, The SE 1/4 of NW 1/4, The NE 1/4 of SW 1/4, portions of the SE1/4 of the SE 1/4 of Section 24 located in T3S, R9W.

Permit amendment area S-335-3 is described as follows: Portions of the SW ¼ of NE ¼ and Portions of the SE ¼ of Section 19; Portions of the SW ¼ and SW ¼ of the SE ¼ of Section 20; The W ½ of the NE ¼ and a portion of the SW ¼ of the SE ¼ and the W ½ of Section 29; Portions of the NE ¼ and Portions of the NE ¼ of the SE ¼, the S ½ of the SE ¼ and the SE ¼ of the SW ¼ Section 30; a Portion of the NE ¼ of the NW ¼ and a Portion of the NW ¼ of the NE ¼, and the E ½ of the NE ¼, The SW ¼ and a Portion of the SE ¼ Section 31; the NW ¼ and W ½ of the NE ¼ , the N ½ of the SW ¼ and NW ¼ of the SE ¼ of Section 32; all located in T3S, R8W; all amendments located in Barton Civil Township, Gibson Co., Indiana.

Somerville South Mine will continue to operate under approved Indiana Department of Environmental Management permits for air and water quality: Air Permit S051-24712-00040 and NPDES Permit ING-040038. The application is available for public inspection at the Princeton [Gibson County] Public Library, 124 S. Hart Street, Princeton, IN 47670,and at the Indiana Department of Natural Resources, Division of Reclamation Office, IN Hwy 48 approximately 1/2 mile west of Jasonville, Indiana. In accordance with 312 IAC 25-4-110 written comments, objections, or a request for an informal conference relative to the application should be addressed to the Director, Division of Reclamation, Indiana Department of Natural Resources, 14619 W.
